Regional Chair Emmerson called the meeting to order at 9:01 a.m. and made the following remarks:

 “We acknowledge the land we are meeting on today is  located on the traditional territory of many Indigenous peoples such as the Anishinaabeg, Haudenosaunee, Huron-Wendat and Métis peoples and the treaty territories of the Haudenosaunee, Mississaugas of the Credit First Nation and Williams Treaties First Nations.

York Region falls under the Nanfan Treaty, Treaty 13 and the Williams Treaties. There are also other land claims and treaty rights involving portions of York Region that have not been resolved.

The Chippewas of Georgina Island First Nation is a Williams Treaty First Nation and the closest First Nation community to York Region.”

Committee of the Whole recommends adoption of the following recommendations, as amended, in the report dated June 3, 2022 from the Commissioner of Public Works:

  1. Council approve in principle, the 2022 Transportation Master Plan, included as Attachment 1 to this report and that staff provide a report in September 2022 once all consultations have been completed.
  2. The Regional Clerk circulate this report to the Clerks of the local municipalities, Toronto and Region and Lake Simcoe Region Conservation Authorities, Ministry of the Environment, Conservation and Parks, Ministry of Transportation and Ministry of Municipal Affairs and Housing.

Committee of the Whole recommends adoption of the following recommendations, as amended, in the report dated May 27, 2022 from the Commissioner of Public Works and the Regional Solicitor and General Counsel:

  1. Council authorize continued use of automated speed enforcement as described in this report, including addition of two new automated speed enforcement mobile cameras in 2022/2023, at an additional cost of $250,000, for a total cost of $750,000.
  2. Council authorize the Regional Solicitor to take necessary steps to establish a Regional administrative penalty system for automated speed enforcement offences and red light camera offences pursuant to Ontario Regulation 355/22, Administrative Penalties for Contraventions Detected Using Camera Systems, including preparation of the necessary bylaw(s), once the Province has provided the enabling regulatory framework, and to include all associated costs, staff resources and potential revenues in the multi-year (2023-2026) budget submission.
  3. Council authorize the Commissioner of Public Works to execute any agreement or ancillary documents required to exercise options to extend automated speed enforcement operating agreements with the Ministry of Transportation, City of Toronto and Redflex Traffic Systems (Canada) Limited.
  4. Council requests the Minister of Transportation make necessary amendments to the Highway Traffic Act that will provide greater discretion to municipal councils in determining where automated speed enforcement may be implemented to advance road safety in a municipality.
  5. That this resolution be circulated to the Councils of the nine local municipalities within the geographic boundaries of The Regional Municipality of York.

Committee of the Whole recommends adoption of the following recommendation in the report dated June 3, 2022 from the Commissioner of Public Works and the Acting Commissioner of Finance:

  1. Upon approval of the Region’s Zero Emission Transit Fund Application Council authorize,
    1. the Commissioner of Public Works to execute a Zero Emission Transit Fund agreement, including the associated Infrastructure Canada grant and Canada Infrastructure Bank loan component, to advance the purchase of electric buses and related infrastructure as detailed in this report
    2. Acceptance of the Canada Infrastructure Bank loan subject to a favourable borrowing rate aligned with the Fiscal Strategy
  2. Subject to the approval of the Region’s Zero Emission Transit Fund Application, Council approve incremental capital expenditures changes and associated funding sources for the new electric buses and related infrastructure as follows:
    1. Incremental capital expenditures from 2023 to 2025 for up to $213 million
    2. Up to an additional $265 million Capital Spending Authority as required to issue contracts for fleet and supporting infrastructure, with further detail in Attachment 1
    3. Debt Authority for up to $137 million
  3. If the Region’s application is successful, Council authorize a one-time exemption to the Council directive of not issuing new tax levy debt to participate in the Canada Infrastructure Bank loan program.

Committee of the Whole recommends adoption of the following recommendations in the report dated May 27, 2022 from the Commissioner of Public Works:

  1. Councils of local municipalities confirm their positions regarding the Region assuming winter maintenance of sidewalks adjacent to Regional roads, given the Regional tax levy implication.
  2. Regional staff work with local municipal staff on opportunities to improve coordination of winter maintenance of sidewalks adjacent to Regional roads for the 2022/23 winter season.
  3. The Region investigate ownership and maintenance of separated cycling lanes as part of the 2022 Transportation Master Plan Focus Area and report to Council in 2023.
  4. The Regional Clerk forward a copy of this report to the local municipalities and request confirmation of their position by September 30, 2022.

Committee of the Whole recommends adoption of the following recommendations in the report dated May 27, 2022 from the Commissioner of Public Works:

  1. Council approve an amendment to the current agreement between the Region and GHD Limited for a new mid-block crossing over Highway 404, north of 16th Avenue, to add new contract administration and site inspection services required during construction of the new road, and increase the contract price, within the Capital Spending Authority, by $4,527,968 from $2,275,797.31 to $6,803,765.31, excluding HST.
  2. Council approve an extension of the agreement between the Region and GHD Limited to provide consultant services for an additional two years, expiring on December 21, 2028, to include new contract administration and site inspection services during construction.

  1. The Regional Clerk circulate this report to the Ministry of the Environment, Conservation and Parks, the Clerks of the local municipalities, the Toronto and Region Conservation Authority, and Lake Simcoe Region Conservation Authority for information. 

Committee of the Whole recommends adoption of the following recommendations in the report dated May 27, 2022 from the Commissioner of Public Works:

  1. Council authorize the Commissioner of Public Works to negotiate, approve and execute a direct purchase for a long-term contract with Emerald Energy From Waste Inc. to provide haulage and processing of up to 50,000 tonnes of residual waste per year from September 16, 2023 to January 28, 2036, with renewal options to 2046 as described in this report and in accordance with Private Attachment 1.
  2. Council authorize the Commissioner of Public Works to negotiate, approve and execute a five-year renewal term to the existing Covanta Niagara contract to provide continued processing of up to 70,000 tonnes of residual waste per year from September 23, 2023 to September 30, 2028 as described in this report and in accordance with Private Attachment 1.
  3. Council authorize the Commissioner of Public Works to negotiate, approve and execute a five-year renewal term to an existing contract with J.E. Culp Transport Ltd. to provide continued haulage services from the Region’s waste transfer stations to Covanta Niagara from October 1, 2023 to September 30, 2028 as described in this report and in accordance with Private Attachment 1.

Committee of the Whole recommends adoption of the following recommendation in the report dated May 26, 2022 from the Commissioner of Public Works:

  1. The Regional Clerk circulate this report to the Clerks of the local municipalities and the Ministry of the Environment, Conservation and Parks.

Committee of the Whole recommends adoption of the following recommendation in the report dated May 27, 2022 from the Commissioner of Public Works:

  1. Council approve aligning the Region’s long-term corporate greenhouse gas emissions target with the Federal government’s 2050 net-zero emissions target as defined in the Canadian Net-Zero Emissions Accountability Act.

Committee of the Whole recommends receipt of the communication from Ika Washington, Communications and Marketing, Manager, Sickle Cell Awareness group dated May 17, 2022 and recognize June 19, 2022 as World Sickle Cell Day.

Committee of the Whole recommends adoption of the following recommendations in the report dated May 25, 2022 from the Commissioner of Community and Health Services:

  1. Council approve the Paramedic Services Master Plan 2021 – 2031, included as Attachment 1 to this report.
  2. The Regional Chair write to the Provincial Minister of Health advocating for expedited rollout of the following: dispatch modernization, new models of care (such as treat and release) and sustainable funding for community paramedicine programs.
  3. The Regional Clerk circulate this report for information to local municipalities, local hospitals, three Ontario Health Teams in York Region and the Minister of Health.

Committee of the Whole recommends adoption of the following recommendations in the report dated May 26, 2022 from the Commissioner of Community and Health Services, the Commissioner of Corporate Services and the Chief Planner:

  1. Council receive the Housing Solutions 2021 Progress Report (Attachment 1) for information.
  2. Council endorse the action plan for 2022 and outlook for 2023 (Attachment 2).
  3. Council direct the Commissioner of Community and Health Services to develop an Emergency and Transitional Housing System Plan.
  4. The Regional Chair submit a letter to Members of Parliament and Members of Provincial Parliament representing York Region requesting they advocate to the Federal and Provincial governments to:
    1. Commit to consistent, long-term capital funding under the Ontario Priorities Housing Initiative (OPHI) to support York Region’s goal of doubling the rate of growth for community housing.
    2. Reconsider York Region’s application for the next round of Canada Mortgage and Housing Corporation’s Rapid Housing Initiative to increase supply of community housing.
    3. Direct revenues generated through Provincial housing policies such as the existing Non-Resident Speculation Tax or a future Provincial Vacant Homes Tax to support affordable housing initiatives.

Committee of the Whole recommends adoption of the following recommendation in the report dated May 26, 2022 from the Commissioner of Community and Health Services:

  1. Council approve the products described in Attachment 1 as corporate standards for a maximum term of five years.

Committee of the Whole recommends adoption of the following recommendations, as amended, in the report dated June 2, 2022 from the Commissioner of Corporate Services and the Chief Planner:

  1. Council adopt the 2022 York Region Official Plan appended as Attachment 1, with further revisions as outlined in Attachment 2.
  2. Council adopt an overlay Schedule identifying lands in the Town of Whitchurch-Stouffville requested to be designated as Provincially Significant Employment Zones as Future Strategic Employment Lands.
  3. Should the Minster amend Reg. 140/02: Oak Ridges Moraine Conservation Plan under the Oak Ridges Moraine Conservation Act to permit the Council endorsed and requested urban expansion in the Town of Whitchurch-Stouffville, the Minister be requested to modify the adopted ROP to reflect the following:
    1. Settlement area expansion for the Stouffville Bethesda Community Area lands as shown on the Maps of Attachment 1 and as outlined Attachment 3; and
    2. Settlement area expansion of the South Gormley Employment Area lands as shown on the Maps of Attachment 1 and as outlined in Attachment 3.
  4. Should the Minister choose not to amend Reg. 140/02: Oak Ridges Moraine Conservation Plan under the Oak Ridges Moraine Conservation Act to permit the Council endorsed urban expansion on the Oak Ridges Moraine in the Town of Whitchurch-Stouffville, the Minister be requested to modify the adopted ROP to reflect urban expansion on the remaining Whitchurch-Stouffville Whitebelt lands.
  5. That the Minister be requested to modify A Place to Grow: Growth Plan for the Greater Golden Horseshoe to identify future Provincially Significant Employment Zones in the Town of Whitchurch-Stouffville for the purposes of long-term planning for job creation and economic development as identified in maps endorsed by Regional Council on March 21, 2019 and as provided to Regional Council and staff.
  6. And that if the Minister determines to include the settlement area expansions and the Whitebelt in Whitchurch-Stouffville that phasing of development be tied to the water & wastewater servicing master plan.
  7. The Regional Solicitor and General Counsel be directed to proceed with the adopting bylaw for the proposed Region Official Plan and repeal bylaw for the 2010 Region Official Plan, effective following Ministerial approval.
  8. The Regional Clerk submit the 2022 York Region Official Plan as adopted, to the Ministry of Municipal Affairs and Housing for approval and forward this report and attachments to the Clerks of the local municipalities for information.
  9. That staff work with the Province to obtain approval including to incorporate any modifications deemed necessary through their review, and report to Council as necessary.

Committee of the Whole recommends adoption of the following recommendation in the report dated June 2, 2022 from the Acting Commissioner of Finance:

  1. Council approve the 2022 gross capital expenditure changes and associated funding sources, as well as changes to 2022 Capital Spending Authority and associated funding sources, including an increase of $13.2 million in Capital Spending Authority debt, as detailed in Attachments 1, 2, and 3.

Committee of the Whole recommends adoption of the following recommendations, as amended, in the report dated June 3, 2022 from the Acting Commissioner of Finance:

  1. Council direct staff, as part of the 2023 Budget process, to bring forward an option that continues the 1% annual tax levy increment to the Rapid Transit Infrastructure Levy (RTIL) for 2023 and 2024, to fund the tax levy contribution needed for the Yonge North Subway Extension.
  2. As part of the 2023-2026 multi-year budget, Council consider further extending the 1% annual increment to the tax levy for 2025 and 2026, to help fund the tax levy portion of other major new infrastructure initiatives that were included as part of master plans, such as the future expansion of Bus Rapid Transit and Housing York Inc. development projects.

Committee of the Whole recommends adoption of the following recommendations in the report dated June 2, 2022 from the Acting Commissioner of Finance:

  1. Council authorize the award of new non-standard purchases, extensions, and increases to existing contracts over five years, or where optional renewal terms are not available, as per Attachment 1 and Private Attachment 1 which identify the contracts between the Region and each supplier for the terms described.
  2. Council authorize Commissioners and Department Heads, or their designates, to execute the contracts approved in this report, including all applicable renewals.

Committee of the Whole recommends adoption of the following recommendation in the report dated June 3, 2022 from the Commissioner of Corporate Services:

  1. Council approve the Commissioner of Corporate Services to make an offer of compensation to the owner of lands in the Town of Aurora, as set out in Attachment 1, which was acquired in accordance with the Expropriations Act (the “Act”).

Regional Chair Emmerson acknowledged the results of the Provincial election held June 2, 2022 and congratulated the Ford government on winning a second four-year term.  Regional Chair Emmerson, on behalf of Regional Council, congratulated all elected and re-elected York Region Members of Provincial Parliament. 

Regional Chair Emmerson noted many celebrated awards received by York Region departments and staff and congratulated recipients for these outstanding achievements:

  • York Region Public Works Department received the Public Works Project of the Year by the Ontario Public Works Association for the York Durham Sewage System Forcemain Twinning Project.
  • York Region Public Works Department received the MTO Road Safety Achievement Award for the Intersection Safety Pilot.
  • York Region Rapid Transit Corporation celebrated a number of Rapid Transit awards that was shared at the June 8, 2022 Board meeting.
  • Mike Rabeau, Director of Capital Planning and Delivery, Public Works received the Greater Toronto Sewer and Watermain Contractors Association Infrastructure Award of Excellence.

Regional Chair Emmerson noted June 20 - 23, 2022 as the dates for this year's Collision Conference.  York Region's Economic Development team along with York Region's local municipalities, York University, Seneca College and ventureLAB have partnered to showcase York Region as a national leader in the technology industry at the conference.

Regional Chair Emmerson welcomed Commissioner Laura Mirabella back as Commissioner of Finance and extended congratulations on a well-run Provincial election campaign.  Regional Chair Emmerson extended thanks to both Jason Li and Kelly Strueby for their great work as they shared the role as Acting Commissioner of Finance and leading York Region's 2022 Budget.

Regional Chair Emmerson noted that the Housing Affordability Task Force meeting has been rescheduled from May 19, 2022 to September 22, 2022 at 9 a.m.

Rizmi Holdings Limited – Update on Request from the City of Vaughan to Permit Urban Development on Rizmi Lands - Solicitor-Client Privilege

 

Committee of the Whole recommends adoption of the following motion:

Whereas the City of Vaughan (“City”) has entered into Minutes of Settlement with Lucia Milani and Rizmi Holdings Limited (“Rizmi”) regarding the resolution of the various land use planning matters on certain lands owned by Rizmi in the City of Vaughan and located on the Oak Ridges Moraine, (“Rizmi lands”); and,

Whereas the City has requested that the Region include the Rizmi lands in the settlement area boundary for urban development in the Regional Official Plan through the current Municipal Comprehensive Review; and,

Whereas the Rizmi lands are the only lands located on the Oak Ridges Moraine in York Region which are subject to a stay by an Order of the Minister of Municipal Affairs and Housing under the Oak Ridges Moraine Conservation Act; and,

Whereas only the Minister of Municipal Affairs and Housing can lift the stay on the Rizmi lands and issue an Order under the Oak Ridges Moraine Conservation Act to permit urban development on the Rizmi lands; and,

Whereas Council considered the proposed settlement and request from the City at the meeting of Regional Council on May 26th, 2022 and received a private memo from staff with respect to the proposed settlement and request;

Therefore, Council hereby resolves as follows:

  1. Should the Minister choose to issue an Order implementing the proposed settlement and request, the Region does not object, subject to the following terms:
    1. The settlement shall result in the resolution of all outstanding appeals of the Regional Official Plan, including all the lands stayed by the Minister’s Order.
    2. The Rizmi lands proposed for urban development will require Plan(s) of Subdivision applications and will be subject to detailed studies and conditions of approval, including but not limited to servicing, grading and any other reasonable conditions of draft approval, all to the satisfaction of the Region.
    3. The construction and conveyance of the Kirby Road extension between Dufferin Street and Bathurst Street by Rizmi or its successor at no cost to the Region, with Rizmi providing any lands required from the Rizmi land holdings for the construction and conveyance of the Kirby Road extension, including any lands located within Parcel 1. The construction and conveyance of the Kirby Road extension will be condition of draft approval for any Plan(s) of Subdivision submitted in respect of all the Rizmi land holdings.
