Item L.9 - Rizmi Holdings Limited – Update on Request from the City of Vaughan to Permit Urban Development on Rizmi Lands - Solicitor-Client Privilege
That Council adopt the following recommendations in Item L.9 of the Minutes of the Committee of the Whole meeting held on June 16, 2022:
Whereas the City of Vaughan (“City”) has entered into Minutes of Settlement with Lucia Milani and Rizmi Holdings Limited (“Rizmi”) regarding the resolution of the various land use planning matters on certain lands owned by Rizmi in the City of Vaughan and located on the Oak Ridges Moraine, (“Rizmi lands”); and,
Whereas the City has requested that the Region include the Rizmi lands in the settlement area boundary for urban development in the Regional Official Plan through the current Municipal Comprehensive Review; and,
Whereas the Rizmi lands are the only lands located on the Oak Ridges Moraine in York Region which are subject to a stay by an Order of the Minister of Municipal Affairs and Housing under the Oak Ridges Moraine Conservation Act; and,
Whereas only the Minister of Municipal Affairs and Housing can lift the stay on the Rizmi lands and issue an Order under the Oak Ridges Moraine Conservation Act to permit urban development on the Rizmi lands; and,
Whereas Council considered the proposed settlement and request from the City at the meeting of Regional Council on May 26, 2022 and received a private memo from staff with respect to the proposed settlement and request;
Therefore, Council hereby resolves as follows:

- Should the Minister choose to issue an Order implementing the proposed settlement and request, the Region does not object, subject to the following terms:
- The settlement shall result in the resolution of all outstanding appeals of the Regional Official Plan, including all the lands stayed by the Minister’s Order.
- The Rizmi lands proposed for urban development will require Plan(s) of Subdivision applications and will be subject to detailed studies and conditions of approval, including but not limited to servicing, grading and any other reasonable conditions of draft approval, all to the satisfaction of the Region.
- The construction and conveyance of the Kirby Road extension between Dufferin Street and Bathurst Street by Rizmi or its successor at no cost to the Region, with Rizmi providing any lands required from the Rizmi land holdings for the construction and conveyance of the Kirby Road extension, including any lands located within Parcel 1. The construction and conveyance of the Kirby Road extension will be condition of draft approval for any Plan(s) of Subdivision submitted in respect of all the Rizmi land holdings.
- The Minister’s Order and any Minutes of Settlement entered into by the parties will be implemented through Planning Act applications.
- Staff is directed to send this Resolution to the Minister of Municipal Affairs and Housing.
